DRAFT EUROPEAN PARLIAMENT LEGISLATIVE RESOLUTION

on the proposal for a directive of the European Parliament and of the Council on the initial qualification and periodic training of drivers of certain road vehicles for the carriage of goods or passengers (codification)

The European Parliament,

 having regard to the Commission proposal to the European Parliament and the Council (COM(2021)0034),

 having regard to Article 294(2) and Article 91 of the Treaty on the Functioning of the European Union, pursuant to which the Commission submitted the proposal to Parliament (C9‑0008/2021),

 having regard to Article 294(3) of the Treaty on the Functioning of the European Union,

 having regard to the opinion of the European Economic and Social Committee of 24 February 2021[1],

 having regard to the Interinstitutional Agreement of 20 December 1994 - Accelerated working method for official codification of legislative texts[2],

 having regard to Rules 109 and 59 of its Rules of Procedure,

 having regard to the report of the Committee on Legal Affairs (A9-0267/2022),

A. whereas, according to the Consultative Working Party of the legal services of the European Parliament, the Council and the Commission, the proposal in question contains a straightforward codification of the existing texts without any change in their substance;

1. Adopts its position at first reading, taking over the Commission proposal as adapted to the recommendations of the Consultative Working Party of the legal services of the European Parliament, the Council and the Commission;

2. Instructs its President to forward its position to the Council, the Commission and the national parliaments.

Proposal for a directive of the European Parliament and of the Council on the initial qualification and periodic training of drivers of certain road vehicles for the carriage of goods or passengers (codification)

COM(2021)0034 of 1.2.2021 – 2021/0018(COD)

Having regard to the Interinstitutional Agreement of 20 December 1994 on an accelerated working method for official codification of legislative texts, and in particular to point 4 thereof, the Consultative Working Party consisting of the respective legal services of the European Parliament, the Council and the Commission examined by written procedure  the aforementioned proposal submitted by the Commission.

The examination of the proposal for a Directive of the European Parliament and of the Council codifying Directive 2003/59/EC of the European Parliament and of the Council of 15 July 2003 on the initial qualification and periodic training of drivers of certain road vehicles for the carriage of goods or passengers resulted in the Consultative Working Party's establishing, by common accord, as follows.

1. In the first sentence of recital 11, the word 'or' should be replaced by the word 'and'.

2. In Article 4, the final words of point (a) 'no later than 10 September 2008' should be replaced by the words 'no later than 9 September 2008', and the final words of point (b) 'no later than 10 September 2009' should be replaced by the words 'no later than 9 September 2009'.

3. The wording of Article 8(3) should be adapted so as to read as follows: 'A driver who has completed a first course of periodic training as referred to in paragraph 2 or in accordance with Article 8(2), first subparagraph, point (b), of Directive 2003/59/EC shall undergo periodic training every five years, before the end of the period of validity of the CPC certifying the periodic training.

4. The reference box preceding the first subparagraph of Article 14 should not have contained the indication '2003/59/EC (adapted)', since that Article consists of a standard wording introduced for codification purposes.

In consequence, examination of the proposal has enabled the Consultative Working Party to conclude, without dissent, that the proposal is a straightforward codification of existing texts, without any change in their substance.
